Islamabad: The Supreme Court Bar Association (SCBA) president, Pakistan Bar Council (PBC) vice chairman, and the Federal Government Employees Housing Authority (FGEHA) director general received notices from the Islamabad High Court (IHC) on Tuesday, seeking details of allotments made in the SCBA Housing Society.
Under the case contesting the land purchase in the housing plan, IHC Chief Justice Athar Minallah issued notifications. The judgement of the Land Supervisory Committee (LSC) formed by the FGEHA, presided over by Justice Maqbool Baqir, was contested by land owners Ahsan Imtiaz Bhatty, Yasar Khan Swati, and Irshad Swati.
According to the petition, the committee proposed land purchase for the society under Section 4 of the statute, which is contrary to the dicta established by the IHC decision on land acquisition.
According to the petition, the FGEHA is forcefully seizing petitioners’ property at a minimal price on the LSC’s orders under Section 4 of the Land Acquisition Act, despite the fact that it is being acquired for a real estate project rather than a public use. The suit asked the court to declare the LSC unconstitutional and its directives unlawful from the start.
